Welcome to Biren! The terms "we", "us" and "our" refer to Biren, operated by Woodini (Israeli VAT number 300554797), based in Israel. Biren operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Biren is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.

However, colors or product appearance may differ from how they appear on your screen due to your device and display settings, and minor variations in color and sizing (within approximately 1-2 cm of stated measurements) may occur between the product photos shown on the site and the item received, due to normal manufacturing and display variance.

We do not warrant that the appearance or quality of any product will meet your expectations or be identical to how it is depicted on the site. Product descriptions are subject to change at any time without notice, and we reserve the right to discontinue any product or limit quantities offered, at our sole discretion.

Section 3 — Orders

When you place an order, you are making an offer to purchase. Biren reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until we confirm acceptance and process your payment. Please review your order carefully before submitting.

Order changes or cancellations may be requested by contacting us and will only be possible before the order has shipped. If we are unable to accommodate a cancellation or change request after an order has shipped, your purchase remains subject to our Refund Policy.

If we do not accept, must change, or must cancel your order, we will attempt to notify you using the email address, billing address, and/or phone number provided at the time of order.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

Section 4 — Prices and Billing

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed, as reflected in your order confirmation email. Unless otherwise stated, posted prices do not include applicable taxes, customs, or import charges.

You agree to provide current, complete, and accurate purchase and payment information, and to promptly update this information as needed so we can complete your transactions and contact you if necessary.

You represent and warrant that (i) any payment information you provide is true and complete, (ii) you are authorized to use the payment method provided, and (iii) charges incurred by you will be honored by your payment provider.

We currently ship to addresses within the United States. All delivery times provided are estimates only and are not guaranteed. We are not liable for shipping and delivery delays caused by the carrier, customs processing, incorrect address information provided by the customer, or events outside our reasonable control (including but not limited to extreme weather, natural disasters, or carrier disruptions). Once we transfer products to the carrier, risk of loss passes to you. A delay in delivery does not relieve you of your obligation to pay for your order.

Our Services, including all trademarks, brands, text, designs, images, and graphics, and their selection and arrangement, are owned by Biren, its affiliates, or licensors, and are protected by applicable copyright and other intellectual property laws.

You must not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, or transmit any material on the Services without our prior written consent. Unauthorized use may violate applicable intellectual property laws. All rights not expressly granted herein are reserved by Biren.

Biren's names, logos, product names, designs, and slogans are trademarks of Biren and must not be used without prior written permission. Shopify's name, logo, and related marks are trademarks of Shopify. All other trademarks on the Services belong to their respective owners.

Section 7 — Optional Tools

You may be provided access to tools offered by third parties as part of the Services, which we neither monitor nor control. Such tools are provided "as is" and "as available," without warranties of any kind, and any use of them is entirely at your own risk. We may in the future offer new features, which will also be subject to these Terms.

Biren is powered by Shopify, which enables us to provide the Services to you. Any sales and purchases made in our store are made directly with Biren. Shopify is not responsible for any aspect of sales between you and Biren, including any injury, damage, or loss resulting from purchased products.

Because the Services are hosted by Shopify, Shopify also collects and processes certain personal information about your access to and use of the Services. The Services and all products offered through them are provided "as is" and "as available," without warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that your use of the Services will be uninterrupted, timely, secure, or error-free. To the fullest extent permitted by law, in no event shall Biren, Woodini, or their officers, employees, affiliates, agents, contractors, or service providers, or those of Shopify, be liable for any indirect, incidental, punitive, special, or consequential damages of any kind — including lost profits, lost revenue, or lost data — arising from your use of the Services or any products purchased through them, even if advised of the possibility of such damages. Notwithstanding the foregoing, nothing in these Terms limits any liability that cannot be excluded or limited under applicable law, including under the Consumer Protection Law, 1981 (Israel) and the Defective Products Liability Law, 1980 (Israel), to the extent applicable.

Section 18 — Indemnification

You agree to indemnify and hold harmless Biren, Woodini, Shopify, and their affiliates, officers, employees, and agents from any losses, damages, liabilities, or claims (including reasonable attorneys' fees) arising from your breach of these Terms, your violation of any law or third-party right, or your use of the Services.

Section 19 — Severability

If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remainder of these Terms will remain in full force and effect.

Section 20 — Waiver; Entire Agreement

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. These Terms of Service, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and us regarding your use of the Services, superseding any prior agreements or communications.

You may not assign or transfer this agreement or any of your rights under these Terms without our prior written consent. We may assign or transfer these Terms without notice to you.

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Haifa, Israel.
